Last updated: 24 September 2026

1. Introduction & Acceptance

These Terms of Use ("Terms", "User Agreement") govern your access to and use of the website located at thereishelp.org.au and any related services, including making a donation, registering for an event, volunteering, subscribing to our newsletter, or submitting feedback (together, the "Website").

By accessing or using the Website, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree with any part of these Terms, please do not use the Website.

These Terms are governed by Australian law, including (where applicable) the Australian Consumer Law contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

2. About There Is Help

There Is Help Incorporated ("we", "us", "our") is an Australian humanitarian non-profit organisation, ABN 36 758 037 083, with its registered address at 10 Somerdale Avenue, Wyndham Vale VIC 3024, Australia. We support communities in Australia and overseas, including in the Democratic Republic of Congo, Burundi, Tanzania, and Malawi, through programs, projects, and events described on our Website.

3. Eligibility & Account Use

You must be at least 18 years old, or have the consent of a parent or guardian, to make a donation, register for an event, or submit information through the Website. By using the Website, you represent that the information you provide is accurate, current, and complete, and that you have the legal capacity to enter into these Terms.

Where a login is provided for staff or authorised volunteers, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

4. Donations

  • Donations made through the Website are voluntary gifts made at your own discretion, and no goods, services, or benefits are provided to you in exchange for a donation unless expressly stated at the time of donation.
  • Donation payments are processed by our third-party payment provider, Stripe. By donating, you also agree to Stripe's applicable terms.
  • You are responsible for ensuring the payment details and donation amount you submit are correct. We will issue a confirmation and, where applicable, a donation receipt to the email address you provide.
  • Tax deductibility of a donation depends on whether There Is Help holds Deductible Gift Recipient (DGR) status for the relevant fund, project, or appeal at the time of your donation. Please refer to your donation receipt, or contact us, to confirm the tax-deductible status of a specific gift, and seek independent tax advice if required.
  • We take reasonable steps to ensure donations are applied to the program or project you select; however, where a specific project has been fully funded, is no longer viable, or is discontinued, we reserve the right to apply your donation to a similar program or to our general fund, consistent with our charitable purposes.

5. Refunds

As donations are voluntary gifts, they are generally non-refundable. However, if you believe a donation was made in error (for example, due to a duplicate transaction or an incorrect amount), please contact us within 14 days at info@thereishelp.org.au. We will review each request on a case-by-case basis and, where appropriate, may issue a refund or correction at our discretion, subject to any processing fees already incurred.

6. Events & Volunteering

Where you register for an event or apply to volunteer with us, you agree to provide accurate registration details and to comply with any conduct guidelines, safety requirements, or event-specific terms communicated to you at the time of registration. We may, at our discretion, decline or cancel a registration, refuse entry, or remove a participant who breaches these Terms or any applicable code of conduct.

7. Acceptable Use

When using the Website, you agree not to:

  • Use the Website for any unlawful purpose or in violation of these Terms;
  • Attempt to gain unauthorised access to any part of the Website, our systems, or another user's account;
  • Upload or transmit any material that is defamatory, offensive, fraudulent, or infringes the rights of any third party;
  • Interfere with or disrupt the operation of the Website, including through the introduction of viruses, malware, or automated scraping tools;
  • Submit false or misleading information, including in connection with a donation, event registration, or feedback submission;
  • Use the Website to solicit donations or promote goods or services on behalf of any other organisation without our written consent.

8. User-Submitted Content

Where you submit content to us — including testimonials, feedback, photographs, or comments through our feedback form — you grant There Is Help a non-exclusive, royalty-free, worldwide licence to use, reproduce, edit, and publish that content on our Website, social media, and promotional materials, for the purpose of showcasing our work and impact. You confirm that you own or have the right to submit the content, and that it does not infringe any third party's rights.

We reserve the right to review, edit, decline to publish, or remove any user-submitted content at our discretion, including content we consider inaccurate, inappropriate, or in breach of these Terms.

9. Intellectual Property

Unless otherwise indicated, all content on the Website — including text, graphics, logos, images, and software — is owned by or licensed to There Is Help and is protected by Australian and international copyright and trade mark laws. You may view and download content for personal, non-commercial use only. You may not reproduce, distribute, modify, or create derivative works from any part of the Website without our prior written consent.

10. Third-Party Links & Services

The Website may contain links to third-party websites or services, including our payment processor (Stripe), Google reCAPTCHA, and social media platforms. We do not control and are not responsible for the content, privacy practices, or terms of use of any third-party site. Your use of those services is subject to their own terms and policies.

11. Disclaimer of Warranties

The Website and its content are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no warranties, express or implied, regarding the accuracy, completeness, reliability, or availability of the Website or its content. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you under the Australian Consumer Law that cannot lawfully be excluded.

12. Limitation of Liability

To the maximum extent permitted by law, There Is Help Incorporated, its directors, employees, and volunteers will not be liable for any indirect, incidental, special, or consequential loss or damage arising out of or in connection with your use of the Website, including loss of data, loss of profits, or business interruption, even if we have been advised of the possibility of such loss. Where our liability cannot be excluded but may be limited, our liability is limited, at our option, to re-supplying the relevant service or paying the cost of having it re-supplied.

13. Indemnity

You agree to indemnify and hold harmless There Is Help Incorporated, its directors, employees, and volunteers from and against any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Website.

14. Privacy

Our collection and handling of your personal information is described in our Privacy Policy. By using the Website, you consent to the collection and use of your information as set out in that policy.

15. Suspension & Termination

We may suspend or restrict your access to the Website, or any part of it, at any time and without notice, where we reasonably believe you have breached these Terms or engaged in conduct harmful to There Is Help Incorporated, our supporters, or the communities we serve.

16. Governing Law & Disputes

These Terms are governed by the laws of the State of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria, Australia, for any dispute arising out of or in connection with these Terms or your use of the Website. Where possible, we encourage you to first contact us to resolve any dispute informally before pursuing formal action.

17. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, services, or legal requirements. Any changes will be posted on this page with an updated "Last updated" date, and continued use of the Website after changes are posted constitutes your acceptance of the revised Terms.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be severed, and the remaining provisions will continue in full force and effect.
